If the house is titled in both parties names as tenants in common, each would be entitled to one half of the value of the house. If the parties cannot agree upon a means of buying the other out, a legal action called an action for Partition could force the sale of the home and the processed evenly divided. We need more facts to give to you a better answer. Who's name is the house titled in? Was there any written agreement between the two of you when the house was purchased? Was there any other joint assets? Your best bet would be to speak with an attorney, this case would have to be heard in civil court opposed to family court if you were never married.

It depends upon how the deed is written out when you bought the house. Is it in one partner's name or both? Were there any written agreements that both partners would own the house? Definitely consult with an attorney in your area.
