How do I get an outstanding warrant lifted?
Anonymous10 views5 answers
I was convicted of impaired driving in SLC, UT 4 years ago. I have since moved to Arizona, paid the fines, and taken the dui classes. How can I get the outstanding warrant lifted? Will the SLC court tell me over the phone if they changed my misdemeanor charge to a felony because I moved out of the state of Utah? I hadn't been in any legal trouble before or since.
First, I assume that you went to the State's website for warrants: https://secure.utah.gov/warrants. If a warrant has been issued for your arrest you probably want to hire an attorney to have the warrant recalled. A lawyer will file a motion to recall the arrest warrant with the issuing court and schedule a time with the court to appear. The reason for the warrant is, most likely, that you failed to complete the terms of your probation. If that is the case, the Court would have issued an Order to Show Cause. If you didn't appear for that hearing, the court would have issued a warrant for your arrest and charged you with an additional FTA (Failure to Appear) charge.
The court does not have the power to amend the Impaired Driving charge to a felony. If you plead to Impaired Driving under the reverter section, then the court will amend the impaired driving conviction to a DUI. If you did not plead under the reverter statute, then your Impaired Driving plea will remain intact.
Once the warrant is recalled, you won't have to fear being having an officer coming to your work and arresting you or being arrested as the result of a simple traffic violation. However, you will be required to present your self in front of the court and explain to the court why you should not be held in contempt for failing to complete the terms of your probation.
It is not clear what you did or didn't do that resulted in the Court issuing the warrant. At this point I think best way to handle this is to retain a criminal defense attorney in SLC to assist you in clearing the warrant.
I'm a bit confused with your description. If you completed all your classes and paid your fines, why would you have a warrant? Use the "find a lawyer" tab to locate an SLC criminal attorney. Give a few a call so they can review your situation to determine the proper course of action. Most firms offer a free consultation.

I agree with Mr. Baker, it is unclear the reason for the warrant, but if it was for violation of your Impaired Driving offense, you need to hire a local attorney to deal with it. It is usually better to be pro-active and address these issues than wait until you are pulled over for a minor traffic infraction and the officer finds out you have an outstanding warrant.

Your question is confusing for a number of reasons. First, a warrant would only be issued if you failed to comply with probation in some fashion (fine payments, counseling requirements, a new offense, etc). If one of those issues applies, a warrant could have been issued and an attorney can assist you in getting the warrant recalled by preparing a motion for you or appearing for you in court on your behalf. Second, I'm confused as to why you think your offense would be enhanced from a misdemeanor to a felony? In Utah, charges can be reduced upon successful completion of probation, but the alternative is not true. A conviction for impaired driving can enter as a conviction for a DUI in certain situations (DUI Reverter), but both charges are typically misdemeanors.
