I am partners with real estate attorney on a transaction . At closing funds were accepted by said attorney and he wrote me a check that bounced and has refused to give me money owed. He has acknowledged he commingled money with his own account and used money for his own purpose.

That is a very unfortunate situation. There are very strict rules for attorneys when it comes to their escrow accounts. If the bounced check was from an Iola account the appropriate bar association will most likely get notice of it directly from the bank. An attorney is not permitted to co-mingle escrow funds with other funds. You always have the option of reporting your complaints to the NYS bar association with regard to improper attorney conduct or representation. You can get access to the complaint forms on the bar association's website. As far as the money that is owed to you as a result of the real estate transaction, you will have to commence a lawsuit against your partner to recover what is due.
