Is the unmarried mother committing fraud by adding the assumed father to the birth certificate?

After 21 years, the "father" is now finding out that he was listed officially as the father of the son. He was never married to the mother, nor did he sign any paternity documents. He never lived with both son and mother ,so he never had access to any of the boys documents. He currently (and always ) supports the son, but the mother is using deception and the court to further extort more from the father. This is part of an ongoing court matter to show the character of the mother and son

No she is not. To the contrary, she is correctly giving the baby an identity and a pedigree. However, if more than one man slept with the mother, the hunt for the truth begins. However, that does not change the child's identity and pedigree. This means the named father owes support and the state will go after him to pay the mother. Some pretty extensive family court litigation to include a paternity hearing will have to unravel the problem.

No, this isn't fraud. The courts will not be bound by the father's name on the birth certificate.

This is not fraud. Paternity tests exist and the facts can be determined based on that test. The process can be complicated procedurally but if you believe you are not the father you do have recourse.
