I had a female spit in my face, what should she be charged with?

I went to the laundry mat when the female attendant had gotten very aggravated with me cause I had arrived at 9:15 pm and the last load had to be in by 9:30 pm, very well within the time frame. She had gotten verbal with me when I decided it would just be better to leave and go elsewhere. After I had gotten all of my belongings back in my vehicle I went back in to get the phone number to make a complaint, at which point the attendant spit in my eyes and mouth, then attacked me leaving scratches. I used only necessary force to get her off of me then immediately ran out the front door and called police. Upon police arrival I was informed by them that I could be charged with harassment if the attendant wanted to push the issue.

If she scratched you she can be charged with Assault 3 or attempted Assault 3.

She could certainly be charged with harassment and depending on your injuries, assault as a misdemeanor. However, having her charged now will likely be difficult since the police made a determination not to arrest at the time of the incident.

Sounds like an assault. But your description makes the prospect of her being charged very small. I suggest you do your laundry elsewhere and put this very unpleasant incident behind you.

She could be charged with harassment in the second degree (a non criminal violation) or assault in the third degree (a class A misdemeanor). I've defended these kinds of cases and in my experience the first person to file a criminal complaint has the better leverage to protect themselves. I suggest you file a criminal complaint first if you suspect she will do the same. It would also be helpful to get a copy of the police report. Best of luck.

It sounds like there could be potential harassment and Attempted Assault in the Third Degree charges. Of course the attendant will say you are the initial aggressor and try to get you arrested as well.
