The air condenser of a neighbor is so loud it makes my entire apartment vibrate and rumble. Water in glasses vibrates. The vibrations come up from the floor into chairs and my bed and cause my heart to race and skip beats. You can hear his condenser outside from 30 feet away. This has made me have to wear earplugs around the clock and I sleep on 2 rubber mats on the floor (the bed vibrates too much) and still feel them. Now they are sending me a cease and desist letter saying I am harassing them but Im not. I told them about it and was told for the first two months they would fix it but they never did so I called the board a couple of times with no response. Two days ago I told the treasurer and she talked to the neighbor who owns it and now they say I am harassing them.

You need to hire a lawyer to draft a cease-and-desist letter to them to stop using the air compressor. Otherwise, you're going to have to sue them to get an injunction have them stop using the air compressor.

I am sorry to read about your problem. You need to review your HOA documents. What provision deals with this situation? Once you determine that, review how to enforce the provision. You may want to hire an attorney who specializes in this type of litigation. The HOA or the homeowner may be responsible for his/her attorney fees. Good luck.

You need to double check the Declaration of Condominium and the Bylaws to see who is liable for the maintenance of the condenser. That will be the party you would name in a lawsuit for an injunction to stop the private nuisance. You should hire a condo lawyer to address this because there are special provisions for litigation against associations if you have to name the condo association.
