Wrongful Death - medical Malpractice- neglect

father passed away after leaving dialysis in unstable condition, bp was in low 70's according to dialysis , but they allowed him to leave(and go home where he lived alone) - anyhow-without signing an AMA, The next day he was found face down on floor deceased. no autopsy was done even though i requested one from several places including the hospital he had a CABG from in 2011. They were aware of seriousness of his condition, as they previously had allowed his bp to become unstable during treatment another day and at that time he was 911 to hospital and admitted three days for the low BP. my dad told me that the center frequently turned off the machine alarms so they wouldn't beep. if they had been on, they would have been alerted beforehand of any impending problems.

Based on the facts you present here, this would be a tough case, if you have some concerns you should contact a local medical malpractice attorney to review your fathers treatment.

Sorry for your loss, and a local malpractice lawyer would need to order his records to send to an expert to review to ascertain whether there was a breach of the standard of care.

I am sorry for your loss. Before leaving the dialysis center he should have been stable especially given the fact that he lived alone. It sounds like there may be negligence on the part of the dialysis center however you still need to be able to prove that his death would not have occurred if he had been treated for his low blood pressure before being discharged. Without an autopsy there will be a number of defenses that may make it difficult to prove that his death was due to the negligence but you should definitely contact an attorney to discuss this matter. There is no cost to you or your family to have the facts reviewed and investigated so that you can get a clear answer to the issues that will be presented in the event a lawsuit is pursued.

I am sorry for your loss. Obviously it is impossible to know if there is a case here without an in depth investigation. With that said, my first thought in reviewing your inquiry is causation. Even if there was negligence on the part of the medical provider here, the plaintiff still has the burden of proving that the negligence more likely than not caused the death. If you feel strongly about possibly pursuing a case, my recommendation is to contact a lawyer who specializes in handling medical malpractice cases. An estate will likely need to be opened in order to obtain the medical records. Make sure you know what the death certificate lists as the cause of death if/when you contact a lawyer to discuss further.
