DUS charges generally carry the possibility of jail time, but it is rarely imposed. You need to get your license valid before going to court, if possible, and you should hire an attorney. Most likely you are facing fines, and possibly a further suspension. If you were improperly notified of the suspension, you may have a defense, but this rarely the case. It's your job to keep your address current with the BMV. If they sent the suspension letter out to the address you gave them, the court is no likely going to entertain an improper notice argument.

Yes, it is jailable, but it depends on your history and the court as to whether or not they will seek jail. You may have a defense if you weren't adequatley notified, but you'll likely need a qualified attorney to sort it out for you. I highly recommend you get your license reinstated (if possible) and hiring a qualified attorney who practices frequently in the court you're charged in. Good luck.

Mr. Dowden's answer is spot on. Contact him or another local traffic attorney for a free consultation. It is criminal IF you had notice and continued to drive. The FREE consultation is the time to spell out the facts and any defenses. Good luck to you. I hope this helps you?
