Is it even worth talking to an attorney about?

I had hip replacement in November 2014. The incision leaked for weeks. I was placed into the hospital in December for a possible infection. I was taken to surgery for it to be cleaned out. Nothing was done and I was placed on antibiotics in the hospital for a week. In January, the incision opened up and a lot of fluids flowed out. I went to the emergency room and was hospitalized. The primary surgeon turned the case over to another surgeon. He performed surgery and it was determined that I had a staff infection all the way to the bone. A temporary hip was placed in, with antibiotic spacers, and was placed on antibiotics for 6 more weeks. A permanent hip was placed in on March 12th. After 3 surgeries in less than 120 days, I feel someone should be responsible, what is your opinion?

Med mal cases are expensive. You may or may not have one. I know that sounds wishy but you need to have another surgeon say that there was a breach of the standard of care. That costs money. You also need all of your records and billing. There are some great med mal lawyers in Austin. I would suggest you get your records as well as the surgery release and make an appointment. The consultation should be free.

You have everything to gain and absolutely nothing to lose by taking your medical records to be reviewed and analyzed by a reputable personal injury lawyer experienced with medical malpractice cases in your state. Most such first time appointments are free anyway..

Complications of infection following surgery is an accepted risk of medical care. It is impossible to prove that it could have been avoided or even the source of the bacteria. The story you describe is not uncommon; major orthopedic surgeries routinely become infected these days despite the best efforts of medical personnel. You may still wish to visit with an attorney about the case but I suspect it will be difficult to recruit an attorney. This is particularly true given that Texas passed sweeping medical malpractice tort reform laws, limiting your ability to assert a claim.

Take all of your medical records, billing statements and insurance information to an attorney or law firm who specializes in medical malpractice. Call the State Bar of Texas (512-427-1463) for further information if you have no idea where to go for legal help. They will give you several names, addresses and phone numbers of individual attorneys and/or firms who will be able to advise you. Some attorneys/firms provide free initial consultations.

Yes. Your records can be ordered by a local dental malpractice lawyer who can send them to an expert to ascertain whether there was a breach of the standard of care.
