Driving without insurance

4 views 6 answers
I was in an accident without insurance. There was little to no damage to either vehicle. Since then, I've obtained insurance but haven't talked to the other driver and haven't got any papers either. I have to go to court and on my ticket is says operating uninsured motor vehicle and checked is property damage and accident. What will happen? Will my license be suspended? I've never been uninsured before.

You should hire an attorney experienced in traffic court matters to represent you. If you show the judge that you have insurance now, you will not have your license suspended unless you have more on your driving record that you have not disclosed to us. You will probably have to pay a fine. Just don't take any chances. Hire an attorney to represent you.

Attorney Friedman has given you good advice. Do not try to handle this on your own.

Mr. Friedman lays it out well. Get a traffic lawyer. The reason for this is twofold. One is to make sure the charges do not affect your driving record and also to make sure your current insurance is proven, which will reduce your fine or punishment. Second, make a deal with the Secretary of State to pay whatever damage there was, or you will have your license suspended. Your traffic lawyer can help out with this.

Appearing in court with proof of insurance will help you but you were still on insured at the time of your accident. Some courts will require you to purchase SR22 insurance. You would be best served by speaking to, and hiring an attorney who regularly handles traffic matters such as yours.

You are only eligible for supervision on the first operating an uninsured motor vehicle charge that results in a finding of guilty. The fact that you have after acquired insurance helps. The fact that there was a minor accident doesn't. If you did get court supervision you will still be required by the Secretary of State to obtain a separate insurance called SR22 for a period of time. If you don't do this or make all your payments and the SR22 lapses then your license would most likely get suspended.
