Massachusetts requires there to be a written agreement if tenants are to pay for utilities, but does it have to be current?

Started off with a lease years ago that stated we pay for utilities. The lease expired 4 years ago and since then we have continued to pay for utilities (single unit townhouse.) Is the initial lease adequate or is it important to keep the lease up to date if tenant pays for utilities? This is purely out of curiosity.
