I want to take my son to NC to live. But I am not on the birth certificate, there is no custody order and she has hand written a letter stating I can have full custody. to cover my side what do I need to do. So I don't get in trouble.

If you and your ex sign an Affidavit of Paternity with the Attorney General's office you will become the presumed father of your client and you will have the same rights as the mother. If you want more than that you will need to file a Suit Affecting the Parent-Child Relationship to be adjudicated the parent of the child given primary custody with the designation to determine the child residence.

You very much need to get a determination of paternity! This is not difficult and should not be too expensive. Since this concerns the life of a child you cannot use private contract to determine rights. Whatever letter you have is worthless.

Easier and cheaper to find a lawyer who is a certified entity to help you and mom execute an acknowledgement of paternity. When you both sign, it becomes a legal finding of paternity. When you call around to find a certified entity, don't allow for confusion by those lawyers who don't thoroughly understand the "AOP" process. Be sure you are getting exactly what I suggested and are executing a form promulgated by the State of Texas---not drafted by the lawyer.
