I wouldn't necessarily say that work schedule would preclude the father from getting custody, but obviously there'd need to be a plan in place as to where the child would be while father's at work. There are many other factors which would need to be assessed to properly gage the father's chances. Thus, schedule a consult with a Westchester Child Custody attorney.

The most relevant factor is who is the child's primary caretaker. In addition to that many factors are considered in coming to a child custody determination where the parents can't agree to a visitation and custody arrangement. The factors revolve around the needs and best interests of the child. Father has a chance, but I advise get a good attorney who will be able to present your case properly. There are so many other details that need to be factored in here and even then it would be hard to give you a percentage on Father's chances.

There are a lot of factors that go into the "best interest" decision. Often, the most important factors are (1) which parent is the primary caregiver and (2) which parent is able to foster a relationship with the other parent. The work schedule will factor into the equation in the sense that it (by necessity) will factor into who is the primary caregiver and who is able to remain available for the child. The home situation will only play a part if the home is somehow "inadequate" by the child being around drugs, not being a clean environment, not having heat or food, etc. The fact that the child may need to share a bed with mom is not a big detractor - especially given the child's age.
