Is there a loophole in the Kentucky Revised Statutes that allow multiple misdemeanors with separate case numbers to be expunged?

I was convicted of four misdemeanor cases between 2009 and 2010 that were not considered the same case (though each one was connected, over a period of months). I have not been convicted of anything else, either before or after this. I was told by my public defender at the time of the last one that seven years after the last conviction that I would be able to expunge all of my convictions and she made it very clear that she meant every single one since the first one, but the Kentucky Revised Statues seem to suggest otherwise, and it seems that in fact none of them can ever be expunged based upon that law. Are there nuances to the law that I'm unaware of, is it possible that an agreement of this nature could have been worked out, or did the public defender essentially lie to m

This is a very particularized area of the law, and it will be important for you to talk to a lawyer experienced in the various ways to accomplish expungement. Yes, it is possible, but it takes some serious legal maneuvering and isn't guaranteed. Talk to several lawyers and get a feel for who you trust.

I looked at this statute and I think there is a strong argument it does not disallow expungement based upon the existence of other misdemeanor convictions. It says a person can petition for expungement of a misdemeanor or series of misdemeanors resulting from a single incident. It does not say such petition is preclude by the existence of other misdemeanor convictions. I also think it would take some doing to get a the court to approve expunging four. You should engage an attorney to look into it.
