Are there any consequences for unpaid fine/charge/community service in 1991?

Criminal Defense 1 views 3 answers
In 1991 I had misdemeanor charge. I think I have paid fine and did community service for the remaining. Thinking back though I was naive to not have all records(receipts etc?) with me. I'm looking into finding my records but am curious to know about what would happen if say I did not fulfill my obligations in community service or fine/charge, what are the consequences? Thinking about this possibility makes me nervous. Thank you

Jail time is the consequence for a probation violation. Your scenario is one we are called about quite a bit at my office. The smart thing to do is get the minute order or microfiche for the case and see what you did or did not do. Then see if there is a bench warrant out for you. You may want to have the warrant recalled, but this will cause the court to set a probation violation hearing, too. At such a hearing, you could be ordered to serve some jail time. First, see if there is a warrant.

Contact the SD Superior Court and review your court file to see what's happening. If you're worried about going to the courthouse, retain an attorney to do it for you. Good luck.

I concur with Mr. Hill and Mr. Finnecy. Best course of action is to retain an attorney to see whether or not there is an outstanding warrant, and if so to handle the matter for you. The outcome is always better if you are proactive and put the matter on calendar to handle it. You will sleep better knowing that everything has been handled.
