Illegal/legal attic being rented.

Bankruptcy and Debt 4 views 2 answers
I rent the first floor of a house, there is a tenant on second floor as well as one in the attic. I need to find out if the attic is a legal apartment but because the house was built before 1938 there is no C of O in the DOB database. How can I find out if the attic is legal to rent without going through the landlord?

Dear Flushing Tenant: The attic tenant would take the "legal" two family dwelling out from legal status since the building is now occupied as a multiple dwelling even if the attic apartment is not legal to use as a residence. You would discover if the third apartment in the attic is "illegal" if the city did not assign a multiple dwelling registration number to the house. If you want a definite answer call for an inspection and allow either the FDNY, the DOB or HPD to issue violations for illegal use.
