What constitutes sexual harassment between landlord and tenant?
Anonymous2 views1 answers
How does one know if a landlord crosses the line? Can a landlord make sexual offers/advances while a landlord/tenant business transaction is being made? For instance during the signing of a lease, returning of security deposits, any other real estatetransactions? Is it less or more appropriate/professional if done after closing versus during business hours?
Actually, Fair Housing Act makes it illegal for a landlord discriminated against a tenant on the basis of sex. This includes sexual-harassment. FHA actually has a complaint form to fill out that govern situations such as this. I do not recall the exact statute of limitations for completing the form, but I would not delay if you intend to proceed against her landlord. Of course, the issue in a case such as this is damages. In the absence of any actual offense of touching, the only cases that I have taken over the years for sexual-harassment or where economic damages have been suffered. So, for example, if the landlord made a pass at you which you rejected, and then the next month eBay did you were raised your rent, then you would have an excellent case that would be of interest to an attorney. If, on the other hand, this is merely a situation where the landlord makes you feel very uncomfortable, but you will not suffered economic losses as a result of the employer's action, then I believe the best practice would be to file a complaint with the Fair Housing Administration, which may afford you some protection.
