How do I go about getting full custody of my daughter in MN?
Anonymous3 views4 answers
My child's father and I never married, he did sign the birth certificate but has never been consistent in her life. In 2008 her and I moved to MN from MT with no objections from him. She is almost 10 yrs, in her lifetime he has shown little interest in being a part of her life. For Christmas this year he asked for her to visit him in MT which I agreed to. He proceeded to threaten to not give her back to me after he had her. I contacted the sheriffs dept in that county and they told me there wasn't anything they could do because there was no established custody either way.
I am sorry to hear that he did that to your daughter. Since you and your daughter has resided in Minnesota since '08 this should be the proper jurisdiction for you to seek a custody and child support order. The custody order will establish time boundaries that you can enforce and force the father to financially support his daughter. Taking these steps will be very helpful for you and your daughter.
Your post is not clear as to the present location of your child. I suggest you confer privately with an experienced attorney at this time and she can assist you. A role of law enforcement is to be peace keepers and police officers are also termed peace officers. It is not uncommon in situations such as these for law enforcement to refer the parent to the civil, famiilycourt.

Is your daughter with you in Minnesota right now? Was your daughter born in Minnesota? The answers to these questions depend on what/if you have legal custody already established by law.
I'm unclear on your current situation - are you saying that your child has been in MT since December? Why haven't you initiated police proceedings? In MN, an unmarried mother has sole legal and physical custody of the child, so no "court order" is necessary to establish that fact. I can't say what the laws are in MT, but you need to get on this ASAP.
