Hubby's out on disability, been with company 25 years. He can work DAY shift with no restriction, they won't move him to days.

Lot of gray area here, there is a temporary day shift opened, hubby has seniority and he wasn't hired exclusively for the overnight shift, it's just where he's been mostly. We're told that we can't do much about it and that they plan to terminate him 9-1-15 when his disability runs out. He can work days with NO restriction. This is borderline Work Comp and we are interested in pursuing that. Americans with disabilities, we are interested in pursuing that. we don't want him to lose his job because he got sick. Company has accommodated many over the years with illness and injury (not job related) so we don't understand why they won't work with him. He's been a model employee, loyal, reliable, and skilled at what he does. which we believe is the real reason they won't switch him to days

It is possible that your husband might have a case under the Americans With Disabilities Act, however these cases are very fact specific. The best way to move forward is to speak with an attorney who handles ADA cases regularly, so they can learn more about your husbands injury and explain your options.

The full details would need to be known. You may hire an attorney to review the matter and provide you with a legal opinion. Such issues tend to be markedly fact specific, and must be reviewed in light of quite complex and detailed laws and principles of law. Tricia Dwyer Esq.
