Understanding how a written agreement in child custody works?

2 views 1 answers
My ex and I have amicably decided to settle child custody\support out of court. Just having a written agreement notarized. Giving me primary physical custody and him visitation. He will have primary decision making over religion and extra curriculars. He wants to do support in a way where its not cash but still tender for helping me financially. What happens if he dishonors the agreement? Is a written agreement of me having primary custody technically legal? Where do I stand legally with custody if it's only a written agreement can I file for a court order if necessary?

Sure a written agreement with you having primary physical custody and him having visitation is legal. The police enforce court orders, so if you are worried about him not honoring the agreement and you call the police they will refer you to court. So what is recommended is that you hire an attorney to take your agreement to court to have the judge turn it into a court order. That's a very inexpensive way to turn your agreement into a court order. There are many child custody attorneys from South Carolina here on who will provide you with a free consultation - search for one and call one! It should only cost you a few hundred dollars to have your agreement turned into a court order! Lawyer up and good luck!
