Can I sue my doctor for withholding information about my pregnancy?
Hello,
My name is holli and currently live in Greeley, CO. I lost my baby in Denver, on April 7th, 2015. A few weeks before that day, I went to Northern Colorado Medical Center due to pain in my abdomen. During my visit at the hospital, I was told, “it was all in my head & that I will be okay to go home”. I didn’t think anything of it, due to this being my first pregnancy, and of course, trusting the professionals with their decision to send me home. Myself or the baby were not checked nor monitored at all during this visit. This was while i was 16 weeks pregnant. At 19 weeks I had a ultrasound with my OB he never asked how my e.r visit went or if I was having anymore pain.
Weeks later, when i was 24 weeks pregnant, i went into Northern Colorado Medical Center for the same reasons. It turns out that i was having contractions and have already dilated to eight centimeters. They stopped the contractions and i was given the choice to go to Pesbytarian / St. Lukes Hospital. Myself and my fiancé Justin decided that going to Denver was in baby’s best interest and chose to be air lifted. After being there for some short time, contractions continued. I gave birth to Anthony Marquez on April 7th, 2015. He weighed 1 pound and 9 ounces with length at 13 inches long. Unfortunately, due to how early he was, he did not survive. He passed away moments after birth due to his lungs not fully matured.
After this tragic event, I had to see my OB for a follow-up appointment. I and my family received information by the Doctor and were told, he withheld important information about her pregnancy and the baby. My doctor knew since the beginning that me nd the baby were at high risk. The doctor knew i was at high risk and knew chances of preterm labor were very high, and figured he could of done nothing about it. He never told me or my fiancé this information at all. When i found out, the other Doctors in Denver told me, that if i would have known this information before 16 weeks, they could of planned a procedure to sew my cervix shut for the duration of the pregnancy. It could of prevented preterm labor and push the survival rate for both the pregnancy and Anthony by far.
So now after me, Justin & our families have received this news in regards to our baby, we have chosen to try and sue my OB and to sue the Northern Colorado Medical Center. However, I want to get some other peoples opinions on what they think. After reading my story, do you think I could have a good case?
