I140 is approved but..
Anonymous2 views4 answers
1) My I140 is approved. But it has my name misspelled. Will USCIS correct it for me on request through my attorneys? What would be the USCIS fee, if any?
2) My employer says he can only give a soft copy of my approved I140 and NOT the original. Is that the case everywhere? Will I run into trouble later for any reason? or will I face any issue in case I move to a new employer before I apply for change of status?
3) When is it safe to change employer after my I140 is approved, if need be?
1) Depending on how the error occurred, there may/ may not be a filing fee
2) I would consider that good luck. Most employers will not share a photocopy
3) You can change jobs at any time as employment is at will. However when it is best time to make the move should be discussed with an attorney after full review.

An I-140 alone does not give you any status. You should speak with your employers attorneys as to the fee for correcting the name. If it is the fault of CIS there may be no fee. When you have status you will have resident card and do not need the approval notice. The I-140 approval notice is your employer's.
Congrats on the I140 approval! 1) Speak to your employer's attorney about the error in spelling your name. 2) The copy is sufficient for inclusion in the I485 application. 3) If you would like to move to another employer, then timing and porting and retention of priority date issues should be discussed with an attorney of your choice to explain available options and risks involved.
Hi
if mistake is made by USCIS then it should not be a problem, Please talk to your Attorney, he can request it to be corrected, needs to send copy of Petition, birth certificate and passport or may be check form I-824 for duplicate approval notice if you can explain the reason why do you need it with corrections.
