A special warranty deed has been filed to take my ex-husband of the deed since I was awared the house. Now I need to change my married name on the deed to my maiden name.
There is no legal need to change your name in the property records unless you just prefer to do so. When you convey the property or refinance it, you will simply be required to provide a certified copy of your divorce decree and execute a "Same Person" affidavit .
Regardless of how title is held, you can contact the applicable tax appraisal district and change your name with them for billing purposes. This is usually handled with a simple form which they will provide to you.
If you are determined to change your name in the property records now, you should contact a local real estate attorney for assistance. This task could be done with a deed, however this is not really a conveyance and it is probably more appropriate to do so with a recorded affidavit acknowledging your change of name and specifically referencing the affected property. If your divorce decree was recorded, you would need to do nothing else, however the decree may contain information you do not want published in this way.
Additionally, you will need to advise your lender, assuming you have a mortgage, of your change of name. Unless done properly, you could end up with a problem with our current lender if they think you have conveyed the property in violation of your Deed of Trust.
