I had a total hip surgery in 2008 I believe. And needed to have a revision in 2013 due to a recall of Depuy. I woke up from surgery with 80% numbness in my whole leg and the foot drop, He said it would go away before I leave hospital, then it will take a few weeks, a few months, 6months now its going on 2 years and still foot drop and about 80 % numbness in my whole leg still. I had a lawsuit with Depuy and I received a settlement due to the recalled part but nothing yet for my pain and suffering for almost 2 years for the foot drop and numbness. As well and a dramatic drop in life activities. I can not even walk securely on grass or anything unstable with out assistance .

Chiropractors aren't medical doctors and they aren't allowed to perform invasive procedures like surgeries. Perhaps you meant orthopedic surgeon(?) Anyway: a bad outcome from a surgery does not necessarily mean a bad doctor. Medicine is not perfect and patients have unintended consequences and complications. That's why, before a procedure, the surgeon obtains informed consent which includes getting the patient to sign an acknowledgement of the risks and possible complications. Anyway: if the surgery was more than two-years ago it sounds like the statute of limitations on your potential medical malpractice claims has run and your claim is now time-barred. Call an attorney who handles medical malpractice and provide the exact date of your surgery. You should also know ahead of time that tort reform in Texas has radically changed medical malpractice. Most claims are not economically viable. It costs tens of thousands of dollars to work-up a medical malpractice claim, and that type of investment is only justified when the damages are catastrophic. Here's an excellent article on tort reform and the state of medical malpractice in Texas: http://www.houstoniamag.com/news-and-profiles/politics/articles/justice-undone-torn-reform-gone-too-far-october-2014

I doubt your chiropractor performed surgery. If he did he may end up in jail. You have somewhat of a complicated issue. Certainly if your "doctor" performed your surgery in a negligent manner this is the basis of a medical negligence lawsuit. I certainly can see the claim that the reason you had this complication was the defective implant and not anything the doctor did. In order to find out for sure you need to retain a lawyer willing to investigate the claim. THe lawyer gather your medical records and have them reviewed by a medical expert to determine 1. if the care and treatment you received fell below the applicable standard of care and 2. if so did an injury result from this negligent care. There is no claim to pursue unless and until such an opinion is secured.
