What do I lose by giving up primary residency?

2 views 3 answers
We lived with his parents with our two children, where he still resides, when I left 2 years ago due to domestic violence. i could not afford to take my kids so I left them, knowing they are safe. He filed joint custody papers that give him primary residency and the promise to not ask for support from me. They also state that our situation can be reviewed annually and we can make changes if necessary. I feel like he is being fair but I do not want to get screwed. He still lives with his parents and I support myself and cannot afford to take them without him agreeing to pay me support, I want this over with but feel like the papers are too good to be true. What should I look for in the papers that might be hurting my future with the children. Btw I was the victim, not him. Please help!

Your question is far too complex for this simple online Q&A forum. If you have a proposed order, you should consult in person with a family law practitioner for specific guidance and advice. We cannot assist you without a review of the facts and documents in your case. While it may be true that your children's father is being fair, there could be hidden pitfalls so you still should consult with an attorney to ensure a good settlement.

The answer is simple - you need to take these papers to an experienced family law attorney for a detailed review, analysis and explanation. These are serious issues that will impact you and your children for years to come - this needs to be done in a proper and thorough manner.

No one here can advise you without reviewing the exact language of the papers, and discussing the problem with you in more detail. Do not sign anything without consulting with an attorney.
