Can I ask for retroactive child support during the time we live together?

I know retroactive child support is not mandatory. When my son was born my ex and I got an apartment together. He was responsible for paying the rent and so fort and I would pay for utilities...he was never buying anything for the baby I always was the one paying for it and during the course of the time we live together I had to pay for the rent twice. He always complained about not having any money at all. He left after 4 month of living and was giving me little to no child support. I want to know what are the chance of me getting back pay from my son's birth...we were never married and he hasn't been involved in his life

Parties who are living together are considered an "intact family." It would be inappropriate to award child support during the time you lived with your baby's father. You would, however, be entitled to retroactive child support from the last time you lived together to whenever the child support is ordered.

Typically in a DOR child support case, you can expect retroactive child support for the 24 months prior to the filing of the petition. He will get a credit for any amounts paid to you during this period. Also, he will get a credit for any months you lived together.

The simple answer is that you can't get child support from someone that you live with during the time that you were living with that person.
