( Franklin County ) Question about active case, and restraining order.

4 views 3 answers
If there is an active case could the mother still leave state, or she can not leave state by law unless she calls and confirms her location, and vacation, etc ..? Lawyer said we could also put a restraining order, and warrant on her if she moves out of state forcing her to return to Franklin County. Is this how this works? Never been in this situation so, would like to know how it works? We're worked on making sure she can't leave.

If this is a criminal case and she is a defendant then it will depend on the conditions of her bond and whether she gets permission from the court to go on vacation. If she is not a party to the case or under subpoena then the court has no authority over her.

It all depends on the type of case. If the case is a criminal case then it is possible that one of the conditions of bond or probation is not leaving the state without permission. If this is a family law/custody issue then unless there is an order from the judge stating that the person can not remove the child from the state then yes she can remove the child. Again it all depends on the situation and type of case. More information would be needed to effectively answer your question.
