How do I get rights to see my grandson in Kentucky (I live in Ohio)?

My grandson has been staying with my husband and I for the past 5 months at LEAST 4 days a week. We have supplied all of his formula, food, diapers, clothes, doctors appts and medications, and paid for childcare while we work. The mother got angry last weekend because she found out my son (the father) has a new girlfriend. The mother came to my house and took the baby and won't allow my husband and I (or my son) to see him. She says she will let me know when she decides to bring him back. My son often comes and stays when the baby is with us (he lives in transitional housing, he has been clean and sober for 8 months). The baby is nine months old and hasn't been away from us for this long since he was three months old. Mom lives in Kentucky, we live in Ohio. Help!

Your son should file a lawsuit now since the child's home state appears to be Ohio. Under the Uniform Child Custody Jurisdiction Enforcement Act the action should be in the place the child resided for the last 6 months or less if a newborn. If he does not file the action he loses several advantages he has, including being what appears to be the primary parent of a child abandoned originally by the mother. If the mother maintains the child she is in control. Grandparents have no independent right to visitation or even contact with grandchildren under decisions from the US Supreme Court if that visitation is against the wishes of the parents or the primary parent. Contact a lawyer now to start the process.
