I have a clear title on the property that my son lives in. I would like to put it in his name.

Ignoring the tax issues, a grant deed is normally used to transfer title to real property.

A grant deed is the most preferred deed. However, if you do not use a title insurance for the transfer, it is best to also provide him an affidavit of un-insured deed after the deed is recorded.

Both answers above are correct. A grant deed provided some promises about the quality of the title you are passing to your son. The tax issues could be significant so please consult a local tax attorney prior to transferring the title to your son.

Depends on who the family member is and what type of property is involved, residential or other. Other considerations are whether transfer is partial or total disposition. As the other attorneys have said, because of tax issues, i.e. capital gains, gift tax, Prop 13 tax, transfer tax, I would definitely talk to an attorney before going through with it.
