Hi, my wife has informed me she's 'unhappy' and wants to split. She makes more than 2 times what I do, so she wants me to move.

I can't afford to move and think that she should move since she is the one who suddenly wants a split. She has contacted our landlord and convinced him that I can't afford this place. I can. She has apparently started a relationship with someone new and that person doesn't like her living with me. We have some other issues to work out, but, this one seems to be the only one we can't agree on.

There is no requirement that one party move out of the home during a divorce. As long as there is no domestic violence, you can both stay until the judge decides what to do.

My colleague is correct. However, it would seem that the chances for someone calling to file a domestic violence complaint or even a false one greatly increases when both parties remain in the house despite the fact that someone has requested the other person move out. Whether rightly or wrongly, it would seem that you may not want to remain in this situation. You may want to consider consulting a local family law attorney to discuss the specifics and obtain some advice on how to proceed.

Consult with an experienced family law attorney in your city/county to discuss your options. Unfortunately, MANY couples in your situation (living under the same roof while a dissolution of marriage case is pending) find the environment unbearable, and one or both eventually end up committing domestic violence or accusing the other of having committed domestic violence. This type of environment is toxic. One of you needs to get out before things escalate.
