If a beneficiary named in a trust dies, do assets that the beneficiary would have received have to go to a blood relative?

My mother is the trustee, my sister and I the two beneficiaries. All still living. I want my wife to receive my share should I die before anyone else. Although, I'd leave my only child some specific amount of money, I would not want her to have a claim to money from this trust.

It all depends on the wording of the trust. The person who made the trust may have included instructions on how a beneficiary's share should be distributed upon that beneficiary's death. On the other hand, some trusts provide that a beneficiary may appoint a person or persons in his or her own will to receive the share. If you have access to a copy of the trust document, make an appointment with an estate planning attorney in your area. He or she will be able to advise you.

Hi there, I agree: you should make an appointment with a local trusts and estates attorney to help walk you through this situation. 's Find a Lawyer feature will assist you in searching by location and by area of law. Good luck to you and your family.

The trust document holds the answer. Normally, it will specify who gets the deceased beneficiary's share in the event of the beneficiary's death.
