Child Support - Not Married

Child Support 3 views 3 answers
Hi...I'm not married but I have a child with someone. I want him to pay child support. We no longer live together...we have been apart for a while. I keep hearing paternity motion but I am just interested in child support. Is there a motion or petition i can file just to ask for child support - nothing else. Thanks

No. If you want child support, you need to start a paternity case.

Paternity must be established before child support is awarded. You can file it yourself, or you can seek help from the Department of Revenue. Good luck.

Before a court orders the person to pay child support, he must make a finding that he is the father. In the Petition for Paternity and Other Relief, you must allege that he is the father. If he denies paternity, a DNA test will be ordered. If he admits paternity, then the court will order child support based upon the financial affidavits that should be filed by both parties.
