Non-compete employment contract
Anonymous1 views2 answers
I had a non-compete agreement with my employer consulting company A in state of IL. Another consulting company B offered me a contract to hire position (written in email) with their client company C all in state of IL. While I was not aware of this that my employer company A and B signed a non-compete that I cannot seek employment with client C without their permission.
Now I have accepted employment with company C in state of NY based on my email offer from company B which stated that I have the right to accept employment after 1 yr.
Company B is now threatening and says its a violation of contract.
Can I hold their contract void based on the email agreement I had with them?
This is just a little too confusing for this forum, and probably in need of more information. You really don't want to rely on some answer from some lawyer here for a result which could get you into a great deal of legal trouble. You need to bring all the papers to an attorney for a good answer based on all the facts and the different case law of the different states.
Non-compete agreements are usually limited in scope and time. While it doesn't sound right that you could be a party to an agreement and bound by that agreement made between two other entities, I wouldn't want you to rely on that.

This answer does not create an attorney-client relationship.
In addition, I tend think that Illinois law may apply to this contract issue as is ancillary based on your stated facts. Ellen is correct that you need a personal consultation for a scenario like this.
