Individuals who desire to file bankruptcy often do not have the funds necessary to pay the bankruptcy lawyer in full immediately in order to file. This makes sense as the very reason for the bankruptcy filing is a shortage of funds. In my opinion, a reputable and caring bankruptcy lawyer should work with the client to establish a payment plan that will not impose a financial hardship on the client. A reputable and experienced lawyer should certainly not be less interested in the client who needs the plan. Generally, bankruptcy lawyers, however, will not actually file the bankruptcy case unless they have received the total fee. So, for those needing a 4 or 6 month payment plan, for instance, once those installments are paid, then the case would be filed. The lawyer meanwhile can recommend things to be done so that creditors don't constantly call you. As every lawyer runs his or her practice differently, I would recommend that you consult different experienced and reputable bankruptcy lawyers to see if they offer payment arrangements and if there are any minimum amounts that you would have to pay. Best of luck, Barbie D. Lieber
I don't see why a lawyer would be less interested in helping someone who needs a payment plan. Usually a deposit and a payment plan is all that is needed to get the creditors off your back. But, your case can not be filed until you are paid in full. That is the law in this part of the country.

Ms. Lieber is on point with her answer related to the filing of a case under chapter 7.
If you make an appointment with an attorney that handles both chapter 7 and chapter 13 cases, that attorney will explain the advantages and disadvantages under either chapter. Many times after having the knowledge about how both chapters work, the client changes his/her mind and chooses to file under the other chapter.
If you choose to file under chapter 13, most lawyers will require a much small amount to be paid prior to the filing of the case because the balance of the attorney's fees will be paid through the chapter 13 plan.
I can't speak for the attorneys in your area, but I sure do. People with financial problems need all the help they can get. I'm sure someone in your area would assist you.
