Do I need a lawyer to change custody and ask for child support?

I got a divorce a few years ago and in the decree I did not ask for child support (he is in medical school and I did not feel comfortable adding an extra financial burden on him) and we agreed to have joint custody. I now would like full custody and child support. My ex husband had a CPS call on him about a year ago and his conduct and judgment has begun to falter with regards to our daughter. I have no desire to change the visitation, but I would like it if he had to spend at least a few days a month solely with her. She loves her dad and I know that he loves her too and it would not be in her best interests to "take him away." However, I feel that I am the person who has been and will continue to make the best decisions for her and keep her well-being in the forefront of my mind.

A divorce decree made be modified each year after the divorce decree. Your divorce decree of three years or more may be modified for child support. Contact the AG or an attorney for the modification assistance.

You have the right to request a modification of your Decree if there has been a material change in circumstances. It sounds like the financial circumstances have changed, so you can request that the court order child support. You are always in a better position if you hire an experienced attorney to advise you and guide you through the legal process. Good luck to you!

I do think you need an attorney for the change in custody. The AG cannot fight that battle.
