I asked during the traffic stop if i could get out of the car since we were in a small car and everyone smoking it was hard to breathe. I had a door slammed on me after i tried to open it. I said again it was hard to breathe still wasnt allowed to. (NOT UNDER ARREST) at this time. I then tried again and was removed from the car and arrested i was intoxicated but i was not aggressive nor vulgar or offensive the Cpt. Told me if would have just shut up i would not have been arrested, my question is IF IM NOT UNDER ARREST THEN WHY AM I FORCED TO SUFFER WITH HARD OF BREATHING? How was i resisting or obstructing? One cop was in training the other is a Sgt any answers that can be answered please email ( [email protected] )

Police officers often arrest people after giving poor instructions. I do not understand the breathing issue. Sorry. The resisting arrest aspect of your arrest is often all in the eyes of the arresting officer. I suggest that you get a copy of the police report and/or the dashcam video and review it. You should also get a local attorney with these types of cases. Show them the video and the report. They often will conflict with one another. Your attorney can use this as leverage in dealing with the prosecutor.
