Monetary judgments and property liens

Real Estate 5 views 4 answers
A few years ago I invested my life savings in building a retirement home on my sons property. Due to conflict and living conditions made intolerable by family members I find it necessary to move. Do I have legal recourse for financial reimbursement on my investment or am I out of luck.

More information is needed before an attorney can answer your question. Are you on title to the property? Have you recorded a lien against the property? Are there any written agreements giving any rights to the property?

Unless you have anything in writting regarding this transaction or unless your relatives would admit to what you are saying you are most likely out of luck. Sorry

There is a possibility that an equitable lien could be imposed by a court against the property. The strength of such a claim would depend on the circumstances that led to, and the reasons for, your expenditures and the responses made by your son to what was happening. It likely would be a difficult and uncertain battle.

What were the terms of your "investment"? That will determine what your rights are. Did you discuss this before you turned over your life savings?
