When choosing a mediator, for a civil/post-divorce matter should I find someone local or someone from another geographic area?

In a small town where judges and lawyers frequent my ex's restaurant/bars, it seems hard to find someone who isn't familiar with him. Should I choose a mediator from the local area or an outsider?

Generally speaking, I would recommend a local mediator who is familiar with the tendencies of the local Judge adjudicating your case. A local mediator is likely to give you a better idea of what the Judge is likely to do in your case if the mediation is unsuccessful than a mediator from another locality. However, if as your questions seems to imply you have sufficient reason to believe that the Judge may be friend's with your ex-Husband, then you may want to discuss with your attorney whether a motion asking the Judge to recuse his or herself from your case needs to be filed. Best of Luck!

I agree with Mr. Houston. The most important thing is to ask any potential mediator if they have any knowledge about you or your husband. Mediators should be objective, third parties and you have a right to make sure the mediator you choose is. Good luck with your case.
