Best interest of children as far as visitation?
Anonymous2 views4 answers
My ex was given summer visitation during mediation. It has been 3 years, and he has only called 3 times, and seen them 4 times. Each time he had his parents there, which is a source of comfort for the kids. This year he plans to take them for the entire summer without his parents involved. He was supposed to take the last year to build a relationship with them, and show his commitment to them, he only saw them once. When does fl consider taking children from their source of comfort and security a problem. The kids have never been alone with him more than about 12 hours. Their grandparents have always been there, but not this year.
If you think there has been a substantial change in circumstances since the agreement (i.e. your ex didn't exercise the timesharing he was given) then you can petition the court for a modification of timesharing. You would have to prove the substantial change in circumstances in addition to best interests.
It is not really clear what you are asking. If you are considering if the court will take away the father's short timesharing that he actually has each year, it is not clear from your post why the court would do that. You state that he was "given" summer visitation - but then you also state that he was supposed to take the last year to build a relationship with them. How was he supposed to do that when he only has summer timesharing? It seems like some relevant information is missing.

Ms. Scanziani is correct, you would have to establish there was a substantial change in circumstances since you agreed to this summer visitation schedule.
