Are you talking about an MSA for future medicals, or repaying Medicare for past medicals that Medicare paid to treat your leg injury? Those are two completely different things. I am not aware of any law that requires you to do anything more than to "consider Medicare's interests" as to future meds. You should have that conversation with your lawyer again, to make sure you have a good understanding of what is going on with Medicare in your case.

You don't have to set up a msa for a personal injury case but you could lose your benefits. There are lawyers who specialize in dealing with these matters so I suggest that you or your lawyer consult with one.

In workers compensation Medicare set aside accounts can be required if the individual is on Medicare and the settlement exceeds $250,000. For settlements under this amount their interests must be considered. This has been true in workers compensation cases in my state however Medicare is getting more aggressive in seeking these in auto cases as well. You and your attorney need to discuss this issue if Medicare has been paying for any of the treatment that you have received or it is likely that they will be responsible for future treatment related to the accident.
