What can I do to protect my child?
Anonymous4 views2 answers
I been a single mom for 12 yrs my daughter been living with me since, her dad had never seen my child, don't know any thing about my child and vice versa my child knows nothing about her dad. recently he made contact with a mutual friend and asked to see the child. My child over heard the conversation and was terrified of meeting him. He has been in and out of jail, and heard he is now using heavy drugs. He's been crazy but now he is just delusional. I know I will never get any child support from him because of his background history, I just want to know can I get full custody of my child with no visitation and is it possible if he just sign all his rights over to me? How will this process work? What do I need to do? What are my rights?
In California you would want to file for custody orders. The process varies depending on whether you and father were married or not when your daughter was born. Since you stated "single" I presume you and father were never married. This means you would need to start a UPA (Uniform Parentage Act) custody case. In order for the court to make custody orders it would first need to establish parentage of the child. You can contact a local attorney or look for more information about unmarried parents on the Sacramento court website.
