I need advice about a collection agency - National Collegiate Trust - suing me for a student loan.

This is a private loan that was being paid faithfully at the same time as my federal loans. I got a year of forebearance, but now that I have consolidated my loans and begun to pay again, NCT has sent a letter from a lawyer to sue me. I am not sure if the private loan got attached in the consolidation.

These cases are normally easily defended and defeated by an attorney who understands how to attack the chain of title and the amount claimed to be owed. Find a consumer attorney on or use the link below to find one.

Generally, private loans are not consolidated with government or government backed loans. However, it is possible that you have defenses to any action by National Collegiate Trust. Private student loans are subject to the same defenses as other consumer debts. Moreover, the collection options for private student loan lenders are more limited than for federal loans. For example, in Pennsylvania, there is no wage garnishment for private student loan lenders. Therefore, even if no defense is available, you should still be able to reach settlement with the assistance of an attorney. I suggest that you speak to a Pennsylvania consumer debt attorney who has experience dealing with private student loan lenders.

Find a consumer attorney and relax. These cases are usually easy to defend.
