No lease or rental agreement?

My lease (on paper) has now gone month to month. That lease was up in 2009. I have NOTHING in writing or does the expired lease agreement still stand for month to month? Is it legal for late fees to be compiled from months prior altogether on 1 5 day notice to pay or quit? Rent has been paid several months already with no problem.

You have a holdover tenancy or what they call a tenancy at sufferance. Your lease is month to month. Chances are there is no basis to charge late fees because there is no written agreement. Click on "Find a Lawyer" above and speak to a landlord/tenant attorney in your area. If you are now current on your rent, and its month to month without a written agreement, then late fees are not reasonable.

You rental agreement is month-to-month after the lease term expires unless there is an automatic renewal that states that the lease will renew for the same term unless notice is given at least 30 days prior to the termination date.
