my son was convicted of driving under the influence in Kansas. Before his license was suspended and he was convicted, he surrendered it and got a license in another state where he was moving for school. He is now residing in a third state and his license is up for renewal on his birthday this year. Will he be able to get a valid license in the new state without having to get the interlock device ordered with conviction in Kansas?
Under the interstate agreement about licensing, your son should have to comply with any restrictions or requirements placed on him by any state before he can get a license in any other state.
If, in practice, the new state doesn't check his record, he might get a license he doesn't deserve, but if everybody follows the law your son should not be licensed, either from state 2 or 3.

I need more information regarding the state that he is currently in. You can also have him call a local avvo attorney in that state, wherever it is. Generally, most state computer systems are linked together and his Kansas problems may follow him to his new location, where ever that is.

I do agree with the other attorneys and have experienced this with some clients involving Kansas. As our office is right by the state border between Kansas and Missouri we often have clients with MO licenses who get Kansas restrictions and don't bother to comply when Kansas suggests that they should. The typical response is that the KS restrictions will follow the person to whatever new state is involved (except maybe Louisiana). At lot of times, the effects of the restrictions are not felt until the license is up for renewal.
So, my feeling, without more information, is that NO he will not be able to get new license without satisfying Kansas interlock device order.
This can make it very difficult since the "primary" license may expire and then there is no valid license.
This anwser will be specific only to Kansas law. I am licensed in Kansas, Arkansas and Missouri.
With regard to the Driver's License Compact (of which KS, MO, and AR are included), there is an eligibility clause that makes it a non-eligibility factor if there is a pending license suspension in ANY STATE. Thus, until the Kansas reinstatement requirements are completely satisfied, according to the Compact law, no other member state can, lawfully, issue a driver's license while another suspension action is in place.
