I live in Florida, about 2 years ago kids mother took off with boyfriend an my kids moved to Georgia, kids came down to Florida on spring break, kids did not want to back to Georgia scared of boyfriend abusive to their mom an verbally abusive to my kid, their mother let them stay in Florida with me their in school now...im scared she is gonna come take them from me....we were never married an she has custody...please help is there anything I can do to keep them with me
If they have been living in Florida for at least 6 months you could file a Petition to Establish Paternity in Florida. If they have not resided here for at least 6 months the children are still considered residents of Georgia. The mother could file a Motion to Dismiss the action here. But until paternity is established by a Court you have no legal rights over your children. You should consult with an experienced family law attorney in the Tampa area to assist you with this matter. I wish you the best of luck.

If you were not married to the mother then you have NO rights to your children until you file a Petition for Paternity and Other Relief and the court recognizes you as the father. The court can then address the issue of parental responsibility and timesharing (what use to be called custody and visitation) as well as child support.
It is highly advisable that you retain a good family lawyer to represent you. The paperwork can be overwhelming and an attorney can help you navigate the legal system.
