How to stop funeral arrangements if family can not agree?

Wills And Estates 3 views 3 answers
My uncle died and we wanna hold a service here and send him back to Mexico after that. His estranged sons want him cremated and then just buried without service. They didn't told my uncle brother's anything. Not where his body is right now or that they donated his organs. They did not have contact with my uncle since a couple of years ago. We were his only family. Can we do something about it? Half of the family is still in Mexico and can't come here.

If your uncle did not leave a will or directions regarding his wishes for the disposition of his remains, his next of kin have the right to make that decision. Even if his sons were estranged, if there is not surviving apouse, the sons have the right to make the decision about how to handle his burial or cremation. I am sorry for your loss.

Absent written instructions from uncle, his sons control funeral arrangements.

Is there a wife out there that he did not divorce. If there is contact her and see if she will help you, I agree with the other answers regarding the next of kin,
