The judge has not granted a motion of discovery for the defendant but now they are asking for our evididence/proof against them.

Defendant wanted a motion of discovery which the judge did not grant, however the defendant want all evidence incl receipts and initial contract because she has lost them, what is my legal right, if any to deny her request. I want to show her unprofessionalism in losing documents by holding on to this evidence.

You need to consult an attorney for your case. If discovery was denied, I am assuming that you are in District or Small Claims Court. While an attorney cannot accompany you to Small Claims Court, consulting with a litigation attorney on this issue is not only allowed, it is highly recommended in order to take advantage of all available strategies with regard to discovery and evidence for your case.
