Expunge Criminal Record
Anonymous3 views2 answers
I have a first time offense misdemeanor that I am currently on probation for (up til this Jan). I plan to file for an expungement seeing as it is my first offense. I am currently studying to be an elementary school teacher at the local university. I know I have to tell put on my teacher's licensure application that I have expunged my criminal record. Do I simply tell them I have had something expunged, or do I have to go into details by law and tell them why and what for?
This question can be best answered by asking the teachers' licensure board and by reviewing their application for how the question is worded. If they want details the application will make that clear. If the question is "were you ever convicted of a crime," it is best answered by the reply í¿es but the conviction was dismissed."
First off, prior to an expungement, you technically still have a conviction on your record. Depending upon how the plea agreement you entered into was structured, you may not have an actual conviction. You must first be very clear about what you entered into. Once this is established, you can then carefully review the application to see what kind of disclosure it requires. You may in fact not have to disclose it. I have dealt with this situation many times with clients and I always advise them to forward the application to me so that I may advise them on how to properly disclose prior criminal matters. Naturally, I like to fall on the side of disclosure but the matter must be treated carefully and considered on a case by case basis for the best results. Lastly, once you actually gain a lawful expungement, you should be able to answer in the negative relating to any prior criminal convictions, otherwise what would be the use of obtaining such an order.
