This is now the 5th time that you have asked this question. Is there any other way that we can answer this for you so that you better understand your situation? Property acquired by the couple during their marriage is marital property and subject to an equitable division. Exceptions are inheritance and gifts. As a co-owner, you have an interest in the car. When the couple divides up the marital assets, you will want to assert your interest in the car.

Please read what Mr. Birchmore has written here and in all of the other postings of the same question. If you and your son purchased the car after the date of marriage and he paid for his portion (or is making payments) from money earned during the marriage, his share of the car would be considered marital property and subject to equitable division during the divorce. The best thing to happen would be for he and his wife to agree that he gets that car in the divorce (and she gets her car or some other equivalent property). If no agreement is reached, a judge will determine how to divide the property including his share of the car. Most likely, since the car is co-owned with you, your son would be awarded the car. That just makes sense. But there are no guarantees. Your son really should discuss the disposition of the car with his attorney.
