Is there a 10 year marriage divorce rule in Mississippi?

My brother is divorcing - no fault - but his wife is procrastinating on filing papers - they have been married 9 years - very close to 10. Will she benefit if she holds out for the 10 year mark?

In a no fault divorce, the parties usually resolve all issues of property division by agreement between themselves, with the agreement put into writing , signed, and becoming pat of a court order. There would be no particular advantage in waiting until the parties were married 10 years, However if the divorce or even the property settlement is decided by a judge, then the 10 year mark is one of several factors the Cout considers when deciding whether to award alimony.

No such rule in Mississippi. A lot of people just don't want to deal with the divorce even if it's a no fault because they feel that doing so is expending energy on something they don't want to deal with in the first place. Your brother just needs to be vigilant in pursuing the divorce. Don't be too pushy or she could drop the ball all together.
